     William B. Penly was listed as AWL just prior to the Battle of Chickamauga.  The Lord works in mysterious ways.  I'm told he was referred to as Short William and Blind William.  I wonder if his blindness is a result of his hospitalization during the Civil War.  If so, maybe the AWL on his record is not appropriate.

The following information is about William Burton Pendley's  Grandfather Jonathan Jr. Pendley.

This is the pension application of one Jonathan Pendley. I do

not know who he is. Jesse's father or brother?

Pickens County  }

 

In person came Thomas Fields, aged 77 years old

resident of Pickens County Georgia before

the undersigned who being duly sworn

says, that he was present in Burke County

North Carolina about the latter part of

1814 or the early part of 1815, when Jonathan

Pendley started to the war of 1812 under

Captain White (is the best of his recollection)

that Deponent then was about 12 years old,

that Jonathan Pendley was Deponents Brother

In Law said Pendley having married Deponents

Father's sister & Deponent went in company with the

said Jonathan Pendley with his Father to

see him Start. That Deponents best recollection

is that Jonathan Pendley was gone about one month

and discharged at Saulsberry. Deponent has

been acquainted with Jonathan Pendley from

his infancy to his death which happened about

the 3rd of February 1861. Deponent is fully satisfied

that Jonathan Pendley's first wife Elizabeth who

was Deponent's Father's sister died in the year 1834, and

the said Jonathan Pendley was married to Milly

Kelley about the year 1835, That Deponent has

known them intimately from the time of

their marriage to the time of his death,

Deponent was living in 8 miles of said Jonathan

Pendley and knows him to be the identical

 

Jonathan Pendley who entered the US

Military service in Burke County, N.C.

as before stated That Deponent did not

see him Married, nor buried, but Depo

nent has frequently see his grave as he

is buried at the church not more than

1/4 mile from Deponents home, That he

now lives in 3 1/2 miles of his widow

Widow Milly Pendley who is apply

ing for Pension that he has lived

near her ever since the death of her

husband and knows her to be his

widow. While Deponent was not personally

present and saw them married yet he has

lived near them ever since and never

heard their marriage called in question

or doubted And Deponent knows that the

said Jonathan Pendley drew a land warrant

through Samuel Tate who may or may not have

been the attorney of record, but Deponent knows

that Milly Pendley the applicant is the widow

of Jonathan Pendley who entered the US Military

service in Burke County N.C. 1814 or early part of

1815, and that obtained a land Warrant since

he resided in Pickens and prior to his death.

That he believes he obtained the land Warrant

about the year 1855 or 1856 while living in Pickens Co Ga

and that I have no interest in his claim my P.O. address

is Jasper Ga.

      And at the same time and place personnally

came Thomas M Cowart, Aged 45 years and Matilda

Padget 38 years both residents of the County of Pickens in

State of Georgia to me well known to be respectable and

entitled to credit. And who being duly sworn according

to law states that they each was personally well acquaint

ed with Johnathan Pendly deceased a reputed soldier

of the war of 1812. They haveing known him in his life

time for fifteen years and twenty years during which time

he resided in the County of Pickens State of Georgia And his

reputation was that of a soldier of the War of 1812.

And that said Johnathan Pendly obtained a Land War

rant on account of his services in the War of 1812 at

which time he resided in Pickens County Georgia the

Land Warrant they think was obtained through the

Agency of Samuel Tate of Pickens County about the

Year or 1855 or 1856. And that said Johnathan Pendly

died at his Residence in Pickens Georgia on or about

the 3d day of February 1861. That affiants was personally

present at his burial. And that said Johnathan

Pendly left a widow surviving whose name is

Milly Pendly. That we are also personally well ac-

quainted with her and has been for the last thirty

  years and thirty three years. We know that she is now a

widow & we know that she has not remarried since

the death of said Johnathan Pendly, But Continues

to be his widow. We also know that she is the

widow of the identical Johnathan Pendly soldier

War of 1812 who obtained the Land Warrant in

Pickens County as above named. We have no

interest in this claim. Our P.O. address is Long

came Mrs. Milly Pendly the applicant who being duly

sworn states that after due search having been

made That there are no public Record or church

Register nor family Record of her marriage to

Johnathan Pendly: And that Nimrod Pendly the

Justice of the Peace who Administered the rites of Marri

age between her and her said husband is Dead,

  and that she is unable to find any witness or to provide

the testimony of any witness now living that was present

at the Marriage to prove said marriage And that

the proof of the reputation of her and her husband

living together as husband and wife is the highest and

best __________ in her _________  to obtain to prove that they

were lawfully man and wife.

personally came Francis M. Cowart aged 45 years

and Sion A. Darnell aged 52 years Residents of the

County of Pickens State of Georgia __  are well known

and whom I certify are sworn according to law

States that they were personally well acquainted with

Johnathan Pendly his wife now his widow in the

life time of the former up to the time that said

Johnathan ________ and _______ which time

they resided in Pickens County as man and wife

for at least fifteen years previous to his death

  in 1861. And that during this period of time

they said Johnathan Pendly and Milly Pendly all

ways lived together as husband and wife and were

reputed so to be lawfully man and wife And

such was their general reputation And that

we were near neighbors and all acquainted

with him. And that we never heard the fact

of their being lawfully married doubted or

called in question by any person whatever.

                     On this ninth day of May A.D. 1855

before me, the undersigned, a Justice of the Superior Court duly authorized by law to administer oaths within and for the County and

 

State aforesaid, personally appeared Jonathan Pendley aged 82 years, a resident

 

of__(blank)__ County of Pickens and State of Georgia

 

who being first duly sworn according to law, declares that he is the identical Jonathan Pendley

 

who was a late Private in the Company, commanded by Captain Gilbert White

 

in the __(blank)__ Regiment of Drafted men commanded by __(blank)__ in the War

 

Declared by the United States against on the 18th June 1812

 

That he was drafted into the United States service at Morgantown, County of Burke

 

and state of North Carolina; on or about the 25th day of Feb 1815

 

to serve for the term of three months; continued in actual service at __(blank)__ during

 

said war, for the term of fourteen days received from U.S. Paymaster Thomas Walton

 

$5.00 pay; and was on or about the 12th day of March 1815 at

 

Morgantown honorably discharged by being with the entire company to which he was attached,

 

mustered out of the service by Capt Gilbert White of the U.S. Army. All of which will more fully appear by refer-

 

ence to the Muster Rolls of said Company; my discharge being lost or mislaid

 

     In addition to the actual service above described, he claims for __(blank)__ miles from __(blank)__ at which he

 

volunteered to __(blank)__ where he was mustered into service. And for __(blank)__ miles from

 

__(blank)__ at which he was discharged, to __(blank)__ the said place of his enrolment.

     He makes this Declaration for the purpose of obtaining the Bounty Land to which he may be entitled under the act of Congress

 

of March 3rd 1855 that he has

 

never having received or known himself entitled to Bounty Land under any Act of Congress, except the one above mentioned.

 

     He hereby revokes any application for Bounty Land previously made, or that may have been heretofore presented in his name at the Department;

 

and he does by these presents irrevoably constitute and appoint SAMUEL M. KNIGHT, of Washington City, his true and lawful attorney, with

 

power of substitution, to prosecute the within mentioned claim, and to receive for the benefit of this deponent, upon this, or supplementary applications

 

the Bounty Land Certificate or Warrant to which he may be entitled, whenever the same may issue.

and Joseph H. Bradley aged forty one years, whom I know to be respectable residents

 

of Harnagiville County of Pickens and State aforesaid, and fully entitled

 

to credit; who made oath in due form of law, that they were present and saw Jonathan Pendley

 

______ foregoing declartion by making oath and affirming his mark _____

 

     They further swear that they are acquainted with the said Jonathan Pendley

 

that they have every reason to believe, and do believe from the appearance of the applicant, and from their knowledge of

 

him, that he is the idetical person he represents himself to be, and who has not heretofore received Bounty Land for his services in the war of 1812 with Great Britain under any act.

 

     They further swear that they are disinterested witnesses.

LETTER FROM PICKENS POSTMASTER IN PENSION FOLDER

 

       Jasper GA Dec 12th 1885

 

Milly Pendley is dead. She died

in March or April of this year

to the best of my recollection

but I do not recollect the exact

date of death. I suppose I

can find out after while by

making inquiries of her relatives

who live somewhere in this

county.
